Google Hangouts unplugging support for XMPP has deep ramifications in the industry: This means that interoperability between Google and Microsoft Lync, XMPP/Jabber based solutions like Cisco Jabber, Openfire, Avaya and many others will also loose interoperability. Will this also put Microsoft Lync in the interesting position of being the the most widely interoperable enterprise UC solution? In conclusion, perhaps the code name “babel”, used internally by Google to describe their unified messaging effort, was indeed an allusion to the Biblical story of the tower of Babel?In that story humans spoke a single language until suddenly multiple languages emerged, making communication between people and groups impossible…

-¿Cuál es el efecto del binominal hoy día?-Hoy día la derecha no necesita sistema binominal para sacar 42 % de los votos; es un porcentaje que tiene –o que puede no tener–. Entonces hoy día, el efecto que tiene el binominal es mucho más grave. El problema del bimonimal es que hace de las elecciones parlamentarias, tongos. Entonces la verdadera decisión es la de quien va en la lista y cómo se conforma la lista y eso es un poder tan grande para los partidos políticos que los está matando. Yo creo que eso está en el origen de la crisis de legitimidad de los partidos políticos. Como tienen este poder tan grande de nombrar parlamentarios, entonces se transforman en puras máquinas. Y toda esta presión por primarias la encuentro bien tonta.

-Pero se plantea como un mecanismo democrático…-La demanda por primarias, sobre todo primarias parlamentarias, tiene sentido porque la cosa es así: ‘mire, la elección es un tongo, lo importante es quien va de candidato. Entonces hagamos elecciones para ver quién va de candidato. O sea, si la elección va a ser un tongo, hagamos elecciones efectivamente’ ¡Pero por qué solucionarlo así! La manera de solucionarlo es que deje de ser un tongo. Es decir, que los partidos se juegen la posibilidad de ganar o perder por llevar buenos o malos candidatos; y eso es suficiente y no porque le conviene a la estructura del partido. Es ingenuo pensar que si una directiva de un partido tiene ese poder no lo va a usar; y una elección primaria es mucho más manipulable que una elección general. Las primarias son un paradigma de una solución incorrecta para un problema real, que es que las elecciones son un tongo y los candidatos son designados por las cúpulas de los partidos.

Supongo que todos ya cachan la debacle del INE, pero es bueno saber los detalles del reportaje que demostraba que tan mal estaba el asunto.

Tres fe de erratas importantes han tenido las cifras del Censo 2012 en sólo 22 días. Y todo indica que van a seguir. Así lo advirtió internamente el cuerpo técnico del INE durante meses, pero fue marginado, hasta que las pruebas de la manipulación de los datos y los errores metodológicos emergieron. Un cuestionamiento similar experimenta el sensible cálculo del IPC, otro producto estrella del INE. Su director, Francisco Labbé, después de rechazar todo error, ahora asume que hay diferencias de hasta cuatro décimas porcentuales en ese índice financiero clave. El INE enfrenta una parálisis y su peor crisis.

Hay un lugar en que la noticia no dejó a nadie indiferente. El anuncio de Michelle Bachelet, sobre la formación de una comisión para evaluar un nuevo texto constitucional, se transmitió por redes sociales con particular velocidad. Los abogados fueron los primeros en reaccionar, pero especialmente los que se graduaron en la Escuela de Derecho de la Universidad de Chile. Es que la noticia no los podía dejar indiferentes. Popularmente conocidos como memes de Internet, estos dos elementos aparecen brevemente como contenido adicional durante Scribblenauts, causando la molestia de Charles Schmidt y Christopher Orlando Torres, creadores de los memes quienes se asociaron para realizar esta demanda legal.

¿Será algo curioso? No tanto, porque tanto Nyan Cat como Keyboard Cat son personajes cuyos derechos de autor están protegidos de forma legal en Estados Unidos, de modo que para efectos legales son tratados igual que el logotipo de Warner Brothers o el Ratón Mickey. Y por haber usado sin permiso estas “marcas”, los autores reclaman compensaciones y el pago de los gastos legales por parte de los demandados, en un caso que la corte resolverá en un plazo aún no estipulado.

My latest Guardian column is “Trademarks: the good, the bad and the ugly,” and it looks at why trademark, at its best, does something vital — but how trademark can be abused to steal common words from our language and turn them into a twisted kind of pseudo-property.

Trademark lawyers have convinced their clients that they must pay to send a threatening notice to everyone who uses a trademark without permission, even where there is no chance of confusion. They send letters by the lorryload to journalists, website operators, signmakers, schools, dictionary publishers – anyone who might use their marks in a way that weakens the association in the public mind. But weakening an association is not illegal, despite the expansion of doctrines such as “dilution” and “naked licensing.”

When called out on policing our language, trademark holders and their lawyers usually shrug their shoulders and say, “Nothing to do with us. The law requires us to threaten you, or we lose our association, and thus our mark.” This is a very perverse way of understanding trademark.

The law is there to protect the public interest, and the public interest isn’t undermined by the strength or weakness of an association with a specific word or mark with a specific company. The public interest extends to preventing fraud, and trademark uses the motivation of protecting profits to incentivise firms to uphold the public interest.
